Terms of service
Last updated 31 October 2026
These terms are the agreement between your business and Loops Tech Ltd ("SendText", "we") for using SendText. They're written to be read. By creating an account or using the service, you agree to them and to our acceptable use policy, which is part of these terms.
1Who can use SendText
SendText is for businesses, sole traders and organisations, not for personal use. You must be 18 or over and able to agree to these terms for the business you name when you sign up. Consumer protection rules that only apply to consumers don't apply to this agreement.
The person who creates the business account is its owner. Owners can invite team members and choose what they can do. You're responsible for everything done under your business account, including by your team, and for keeping logins secure. Tell us straight away if you think someone has got into your account.
2What we provide
We let you keep a list of contacts, send them text messages (one-off campaigns and automatic texts), receive and answer replies, see reports, and use optional AI tools to help write messages and replies. We may change or improve features over time. If we remove something you rely on, we'll tell you first where we reasonably can.
Texts travel over mobile networks we don't control. We aim for a reliable service but can't promise every text arrives, or arrives at a particular time. Networks can delay, filter or block messages.
3Your responsibilities for the texts you send
You are the sender of every text you send through SendText, and you're responsible for it. In particular:
- you must only send marketing texts to people who have agreed to get them from you, or who fall within the "soft opt-in" for your own existing customers, as the Privacy and Electronic Communications Regulations (PECR) and UK GDPR require;
- you must be able to show how and when each person agreed, if asked;
- every marketing text must say who it's from and how to opt out, and you must honour opt-outs at once;
- what you send must be lawful, accurate and not misleading, and follow the acceptable use policy.
SendText has safeguards (opt-out handling, quiet hours, a weekly limit, consent records), but they help you comply; they don't replace your own responsibility. If you use our AI tools, check what they write before you send it: you're responsible for the final message.
4Credit, prices and payment
- SendText is pay as you go. You buy credit in advance and each text uses credit at the price shown in the app when you send it. There's no contract, and no monthly fee unless you rent a reply number.
- A text is charged per message part: up to 160 standard characters, or 70 if it includes special characters such as emoji, with longer messages split into parts. The app shows how many parts a message uses before you send it.
- Campaigns, automatic texts, sign-up confirmations and replies you send from the inbox all use credit. Texts people send to you are free. If a network tells us a text wasn't delivered, we return its credit to your balance.
- Payments are taken by our payment provider, Stripe. Prices include or add VAT as shown at checkout. If you turn on automatic top-up, you authorise us to charge your saved card the amount you chose whenever your balance falls below your threshold, until you turn it off.
- Reply numbers. You can rent a mobile number customers can text back, at the monthly price shown when you choose it (currently £4.99 a month in the UK). The first month is taken from your credit when you rent it, then the same amount each month on the same date. If there isn't enough credit, we'll email you and keep the number for 7 days; if it still can't be paid, we release it. You can give a number up at any time; the month you've already paid for isn't refunded. Numbers belong to our provider, not to you: once released, a number may go to someone else and can't always be got back.
- Credit doesn't expire while your account is open. Credit isn't cash, can't be transferred to another business and isn't refundable, except as described in section 9 or where the law requires it.
- We may change prices for future texts and reply numbers. We'll show the new price in the app and give you at least 30 days' notice by email before it applies to credit you've already bought or a number you already rent.
5Your data, and your customers' data
Your contact lists, messages and replies belong to you. You can download or delete your contacts at any time.
For the personal data of your contacts, you are the controller and we are your processor under UK GDPR. We will:
- only use it to provide SendText to you, on your instructions, and not for our own marketing;
- keep it confidential and make sure our staff are bound by confidentiality;
- keep it secure with appropriate technical and organisational measures;
- use only the sub-processors needed to run the service (such as our hosting, SMS network, payment and AI providers), with written terms that protect the data, and tell you before we add a new one;
- help you answer requests from people exercising their data rights, and with security and compliance duties;
- tell you without undue delay if we become aware of a personal data breach affecting your data;
- delete or return the data when you close your account, unless the law requires us to keep it;
- make available the information you reasonably need to show these obligations are met.
To protect you and the people you text, we keep a record of opt-outs and consent changes even after a contact is deleted, so someone who said STOP can't be texted again by mistake.
We use account information about you and your team (such as names, emails and mobile numbers) to run the service, keep it secure and contact you about your account, as our privacy policy explains.
6Suspension
We may pause sending, or suspend an account, if we reasonably believe it's breaking these terms or the acceptable use policy, putting the service or other customers at risk, or if a network, regulator or the police asks us to. Where we can, we'll tell you why and give you a chance to fix things first. We may also refuse to send a text that we reasonably believe breaks the law.
7Our liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
- We're not liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss.
- We're not liable for texts that are delayed, filtered or not delivered by mobile networks, beyond returning the credit for undelivered texts.
- Otherwise, our total liability to you in any 12 months is limited to the amount you paid us in the 12 months before the claim.
8Your liability to us
If a claim, fine or penalty is brought against us because of texts you sent, or because you broke these terms, the acceptable use policy or data protection law, you'll cover our reasonable losses and costs arising from it.
9Ending the agreement
- You can stop using SendText at any time, and an owner can close your account in Settings. You can reopen it within 30 days; after that your contacts, messages and campaigns are deleted. Download anything you want to keep first.
- When you close your account, any reply number you rent is released, your saved card is removed, and you can ask for a refund of credit you paid for and haven't used, within 12 months of closing it. Free or promotional credit isn't refundable.
- We can end the agreement with 30 days' notice, and refund unused paid credit. We can end it immediately if you seriously or repeatedly break these terms or the acceptable use policy, in which case unused credit may be kept to cover our losses.
- Sections 5, 7, 8 and 11 continue after the agreement ends.
10Changes to these terms
We may update these terms. For changes that matter, we'll email the account owner at least 30 days before they take effect. If you keep using SendText after that, the new terms apply. If you don't agree, you can close your account and get your unused paid credit back.
11General
- These terms, with the acceptable use policy, are the whole agreement between us about SendText.
- Neither of us is responsible for delays or failures caused by events beyond our reasonable control.
- You can't transfer this agreement without our agreement. We may transfer it to a company that takes over SendText.
- If part of these terms can't be enforced, the rest still applies.
- No one else has rights under these terms.
- English law applies, and the courts of England and Wales have exclusive jurisdiction.
